The St. Clair Record reports that DVD rental kiosk company Redbox has moved to dismiss a class-action suit filed in St. Clair County, Ill.
Lead plaintiff Laurie Piechur filed suit against Redbox in October 2009 on claims that the company breached a contract with her. She alleged that the $1-per-day charge for DVDs not returned to Redbox kiosks is unfair.
The plaintiffs seek a judgment of more than $350,000 and attorney's fees.
In Redbox's March 18 filing, the company dismissed the suit for allegedly failing to state a claim.
"The Complaint does not establish in what ways the fees are oppressive, against public policy or
subsequently injurious to consumers," the motion reads.
