20th Century Fox Home Entertainment has filed a motion to dismiss redbox' antitrust lawsuit, according to a report from Variety, an entertainment-industry magazine and Web site.
According to Variety, Fox claims it proposed a fair business deal to redbox similar to those it offers other retailers:
The studio denies that it ever refused its titles to redbox. Fox did offer the kiosk company similar pricing and distribution terms that have been accepted by other store customers, it said in the filing. However, redbox decided to refuse these terms, giving Fox the right to adjust its business relationship, the studio maintains. In fact, Fox could have chosen to stop selling DVDs completely to redbox, but is allowing distributors to service redbox with its titles 30 days after street.
Redbox has been embroiled in legal battles with multiple Hollywood studios since it sued Universal Home Entertainment in late 2008.
In addition to the motion to dismiss, Fox also is seeking a venue change to Los Angeles from Delaware, where the proceedings are being held now.
